Event Participation Agreement, Assumption of Risk, Release of Liability, and Indemnification

Effective Upon Purchase and Acceptance During Checkout

By purchasing an official Earth World Running Company event T-shirt through EarthWorldRunning.com and affirmatively agreeing to this waiver during the checkout process, I acknowledge that I have read, understood, and voluntarily agree to the following terms:

1. Participant Agreement

I understand that my purchase of an official event T-shirt constitutes my registration and participation in an Earth World Running Company event, activity, group run, race, challenge, or gathering (collectively, the "Event"), and that this Agreement governs my participation.

2. Assumption of Risk

I understand that running, walking, hiking, volunteering, spectating, traveling to and from the Event, and participating in any Event activities involve inherent risks, including but not limited to:

Falls and slips
Uneven terrain
Motor vehicle traffic
Wildlife
Weather conditions
Heat, cold, lightning, or storms
Physical exhaustion
Dehydration
Equipment failure
Actions of other participants or spectators
Serious bodily injury
Permanent disability
Death

I knowingly and voluntarily assume all risks associated with participating in the Event, whether known or unknown, foreseeable or unforeseeable.

3. Release of Liability

To the fullest extent permitted by law, I release, waive, discharge, and covenant not to sue:

EarthWorldRunning.com
Maddox Formica
All owners, officers, directors, employees, volunteers, contractors, race directors, organizers, sponsors, vendors, affiliates, partners, successors, assigns, and agents
Any municipalities, property owners, governmental agencies, or organizations associated with the Event

(collectively referred to as the "Released Parties")

from any and all claims, liabilities, demands, actions, damages, losses, expenses, attorney fees, or causes of action arising from or relating to my participation in the Event, including claims arising from the ordinary negligence of any Released Party.

This release includes claims for:

Personal injury
Illness
Death
Property damage
Economic loss
Emotional distress
Medical expenses

4. Medical Treatment

I authorize emergency medical treatment if necessary.

I understand that neither Earth World Running Company nor any Released Party is responsible for providing medical insurance or medical care.

I accept full responsibility for all medical expenses incurred.

5. Physical Condition

I certify that:

I am physically capable of participating.
I have consulted a physician if appropriate.
I assume full responsibility for determining whether I am medically fit.

6. Compliance with Rules

I agree to follow all Event rules, instructions, safety guidelines, and directions given by Event staff or volunteers.

Failure to comply may result in removal from the Event without refund.

7. Personal Responsibility

I understand I am solely responsible for:

My own actions
My equipment
My health
My transportation
My hydration and nutrition
My safety throughout the Event

8. Photography and Media Release

I grant Earth World Running Company permission to photograph, video record, or otherwise capture my likeness during the Event.

I grant an irrevocable, worldwide, perpetual, royalty-free license for Earth World Running Company to use my name, likeness, image, voice, and photographs for promotional, advertising, educational, or commercial purposes without additional compensation.

9. Indemnification

I agree to defend, indemnify, and hold harmless the Released Parties from any claims, lawsuits, damages, attorney fees, costs, or liabilities arising from:

My participation
My negligence
My violation of Event rules
Claims brought on my behalf or by third parties arising from my conduct

10. Minors

Participants under eighteen (18) years of age must have this Agreement accepted by a parent or legal guardian.

The parent or guardian agrees to all terms on behalf of the minor and further agrees to indemnify the Released Parties from claims arising from the minor's participation.

11. Refund Policy

Unless otherwise stated by Earth World Running Company, Event registrations and T-shirt purchases are non-refundable.

Event cancellation, postponement, weather conditions, or route modifications do not create a right to a refund.

12. Governing Law

This Agreement shall be governed by the laws of the State in which Earth World Running Company is organized or principally conducts business, without regard to conflict of law principles.

Any legal action arising under this Agreement shall be brought exclusively in the appropriate state or federal court located within that jurisdiction.
